Seeking relief for medical marijuana patients on probation and parole

Empire State NORML et al. v. New York State Department of Corrections and Community Services et al.: David filed an action seeking declaratory and other relief for certified medical marijuana patients who are also probationers and parolees. The Plaintiffs are a nurse practitioner, and several state-registered patients. The lawsuit contends that the DOCCS and its subsidiaries violate state law by prohibiting petitioners access to cannabis while they serve out their term of probation supervision. The complaint alleges that they have been deprived of their rights under the Compassionate Care Act and the specific protection that they may not be discriminated against for such medical patient status.
